Farm Bureau says Supreme Court ruling brings clarity

Earlier this week the Supreme Court denied the Trump administration’s request to pause the litigation over the Clean Water Rule.

Farm Bureau general counsel Ellen Steen says the ruling will allow the Supreme Court to decide which court is the correct court to hear challenges to the rule.

“This is going to bring us and other industry parties and the government clarity about how to deal with these conflicts when they come up,” she says. “That’s the reason we think it’s a good thing for the Supreme Court to go ahead and resolve this issue even while the administration is moving forward – we hope – to repeal this rule.

In late February President Trump issued an executive order to rescind the rule, formerly known as the Waters of the US. In March Trump ordered the EPA and the Army Corps of Engineers to begin the reconsideration process.
